1. Acceptance of Terms

By accessing or using OverThinQ (“the Service”), available at overthinq.ai, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

OverThinQ is operated by OverThinQ (“we,” “us,” or “our”). These terms constitute a legally binding agreement between you and OverThinQ.

2. Description of Service

OverThinQ is an AI-powered decision intelligence platform that helps users analyze their decisions through cognitive bias detection, red team analysis, game theory modeling, Bayesian reasoning, and decision framework recommendations.

The Service uses artificial intelligence (specifically Google's Gemini API) to process your decision descriptions and generate analytical insights. The Service also provides educational content about cognitive biases and decision-making frameworks.

4. User Accounts & Sessions

The Service uses session-based authentication. When you sign up or log in, a session is created and maintained via browser cookies. You are responsible for maintaining the security of your session and any activity that occurs under it.

You agree to provide accurate information when creating an account and to notify us immediately of any unauthorized use of your account.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Submit content that is harmful, threatening, abusive, defamatory, or otherwise objectionable
• Attempt to gain unauthorized access to the Service, other accounts, or computer systems
• Use automated tools, bots, or scripts to access or interact with the Service without authorization
• Interfere with or disrupt the Service or its infrastructure
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Resell, redistribute, or commercially exploit the Service without permission

6. Payment Terms

OverThinQ offers both free and paid subscription tiers. The free tier provides limited access to core features. Paid subscriptions (“Pro”) unlock additional analysis capabilities and higher usage limits.

• Billing: Paid subscriptions are billed on a monthly or annual basis through our payment processor, Stripe. By subscribing, you authorize us to charge your selected payment method.
• Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access to Pro features until that date.
• Refunds: Subscription fees are generally non-refundable. If you believe you have been charged in error, please contact us.
• Price Changes: We reserve the right to modify pricing. Existing subscribers will be notified at least 30 days before any price increase takes effect on their account.
• Invite Codes: Promotional invite codes may grant temporary or permanent access to Pro features. These codes are non-transferable and may be revoked at our discretion.

7. Intellectual Property

The Service, including its design, text, graphics, icons, images, code, and AI-generated content structure, is owned by OverThinQ and protected by intellectual property laws.

Your content: You retain ownership of the decisions, situations, and notes you submit to the Service. By submitting content, you grant us a limited license to process it through our AI systems and store it for the purpose of providing the Service to you.

AI-generated analysis: The analyses, bias reports, and insights generated by the Service are provided for your personal use. You may use them for your own decision-making but may not represent them as professional advice to others.

8. Data Handling

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the data practices described in our Privacy Policy.

In particular, please note that the decision text you submit is sent to Google's Gemini API for AI analysis. Please review our Privacy Policy for full details on how your data is processed and stored.

9. Limitation of Liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OVERTHINQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may stop using the Service at any time.

Upon termination, your right to use the Service ceases immediately. We may, but are not obligated to, delete your data following termination. If you wish to have your data deleted, please contact us.

11. Changes to These Terms

We may update these Terms of Service from time to time. When we do, we will revise the “Effective Date” at the top of this page. We encourage you to review these terms periodically.

Continued use of the Service after changes are posted constitutes your acceptance of the modified terms. If you do not agree to the updated terms, you should discontinue use of the Service.
